The following privacy policy is intended to inform users of the way in which ListenTo, operated by CJS CLOUDWARE, utilizes and collects the personal data of users, as well as choices users have around disclosure of said data. Data is used only to optimize ListenTo services.
By continuing to use ListenTo services, users agree to the utilization of collected user data as outlined in the following Privacy Policy. Definitions of terms used in this policy are in accordance with the ListenTo Terms and Conditions document.
Service: the service is ListenTo, operated by CJS CLOUDWARE.
Personal Data: identifying data of a living user of the service, as well as informations that are in our possession or likely to be in our possession through users use of the service
Cookies: pieces of data stored on the device (including but not limited to phones, tablets, and computers) used to access ListenTo
Data Controller: For this privacy policy, the data controller is CJS CLOUDWARE, previously mentioned operator of ListenTo. The data controller is the natural or legal persons who, alone or in a joint/common other persons, decides the purpose and method in which personal data and information is to be possessed.
Data Processors: also known as a Service Provider. The data processor is the natural or legal persons who processes data for the data controller. CJS CLOUDWARE may utilize several Services providers in the aim of optimal data processing.
Data Subject/User: any living individual utilizing ListenTo and who is the subject of personal data
CJS CLOUDWARE collects several types of information for various purposes in order to improve and continue providing the ListenTo service to users.
Personal Data: to use the ListenTo service, users may be asked to provide personally identifiable informations that may be used to contact or identify you, i.e personal data. This information includes, but is not limited to First and last names Email Address Social media usernames and URLs Credit card type, name, expirations
Personal data may be used to contact users with newsletters, promotional materials, and other information deemed of possible interest to the user. Users may opt out of receiving any or all communications from ListenTo by following “unsubscribe” links, prompts in ListenTo provided emails, or be directly emailing at [email protected]
CJS CLOUDWARE may also collect information on how ListenTo is accessed and used, i.e usage data. Usage data may include user’s computer IP address, browser version and type, pages visited on ListenTo, time spent on these pages, time and date of visit, and unique device identifiers/diagnostic data.
User IP addresses are never stored in CJS CLOUDWARE databases. IP addresses are used solely to obtain general and anonymous data about user profiles such as approximate locations (cities, countries, etc)
CJS CLOUDWARE may use and store data on user location if previous permission has been granted. Location data is used to provide ListenTo features and to customize the ListenTo service. CJS CLOUDWARE may also store and collect information about visitors of ListenTo profiles. This is also anonymous and done in a way that does not prioritize nor focus on “who” is visiting, but “how” they are visiting.
Tracking Cookies Data: Cookies and similar tracking technology is used to track the activity on ListenTo and to store certain information. Cookies are small files with small bits of data that may include anonymous unique identifiers. Cookies are sent to the user's browser from a website and stored on the user’s device. Tracking technologies include tags and scripts used to track and collect information in the aim of analysis and optimization of the ListenTo service. Users can order their browser to refuse all cookies and to indicate where said cookie is being sent. However, if ListenTo cookies are refused, some portions of the ListenTo service may be disabled.
CJS CLOUDWARE, the operator of ListenTo, uses collected data for several purposes:
Providing maintenance of ListenTo, Notifying users of changes to ListenTo, Allowing user participation in interactive features with users choose to do so, Gathering analysis or valuable data so as to improve service, Providing customer support, Monitoring ListenTo usage Detecting, addressing, and preventing technical issues Providing news, special offers, and information on other services offered by CJS CLOUDWARE similar to those already in use by the user, unless already previously opted out of
CJS CLOUDWARE will retain user personal data only for as long as is necessary for the purposes outlined in this privacy policy. Personal data will be retained to the extent necessary to comply with legal obligations (some applicable laws require retention of user data), to resolve disputes, and to enforce legal agreements and policies. CJS CLOUDWARE will also retain usage data for internal analysis purposes. Usage data is retained, typically, for a shorter amount of time than personal data, unless the data is being used to improve security of functionality of the ListenTo site, or if CJS CLOUDWARE is legally obligated to retain the data for longer periods.
User information, including personal data, may be transferred and stored on computers outside the user’s state, province, country, or government jurisdiction; it may be stored where the data protection laws are different from the user’s own jurisdiction. If the user is located outside of Europe and choose to provide data to CJS CLOUDWARE, please note that data, including personal daa, is transferred to the United States of America and processed there.
ListenTo is operated in an office in Australia. CJS CLOUDWARE executes the processing and security of data from Australian personnel, but servers and data are stored both in The United States of America and Australia, User consent to this privacy policy followed by submission of data, including personal data, is agreement to this transfer. CJS CLOUDWARE takes all reasonable steps necessary to ensure user data is treated securely and in line with this privacy policy. No transfer of user personal data will take place to a country or organization unless adequate controls are in place to ensure the security of user data and other personal information.
User data security is important to CJS CLOUDWARE, however it is important to note that no method of internet transmission or method of electron storage is 100% secure. CJS CLOUDWARE strives to use commercially acceptable means of protection for user personal data, but cannot guarantee absolute security.
CJS CLOUDWARE may emply third party companies and individuals to facilitate ListenTo, to provide the service on CJS CLOUDWARE’s behalf, to perform service-related services, or to assist CJS CLOUDWARE in analysis of service usage. Third parties have access to user personal data solely to perform these tasks on behalf of CJS CLOUDWARE and are obligated not to disclose or use user data for any other purpose.
CJS CLOUDWARE may use third party service providers to monitor and analyse the use of ListenTo services.
Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of ListenTo. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. Users can opt-out of having their activity on ListenTo available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity. CJS CLOUDWARE analyzes all traffic through our infrastructure in a centralized, third party location using Papertrail cloud logging.
Google AdWords Google AdWords remarketing service is provided by Google Inc. CJS CLOUDWARE may provide paid products and/or services within ListenTo. Third-party services are used for payment processing (e.g. payment processors). CJS CLOUDWARE will not store or collect user payment card details. User payment card details are provided directly to the third-party payment processors whose use of user personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. CJS CLOUDWARE highly advise users to review the Privacy Policy of every site they visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
ListenTo profiles are populated by the user’s who built the profile. Any links, images, websites, or text are not operated by ListenTo and ListenTo is not liable for anything users or visitors may click on.
ListenTo does not address anyone or knowingly market to anyone under the age of 18 ("Children"). CJS CLOUDWARE does not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and your child has provided CJS CLOUDWARE with information, please contact us. If we become aware that we have collected personal data from children without verification of parental consent, steps will be taken to remove that data.
CJS CLOUDWARE may update our Privacy Policy. Users will be notified of any changes through the positing of the new Privacy Policy on this page. Users will be notified via email and/or notice on ListenTo before changes are effective and. CJS CLOUDWARE will update the "effective date" at the top of this Privacy Policy. The GDPR requires organizations to provide more information about the way individuals’ information is used. ListenTo delivers on our customer’s privacy policy objective by enabling comprehensive data flow and process maps for the customer’s data which is updated and is in line with the GDPR guidelines. We incorporated a Data Processing Addendum (DPA) into our Terms of Service so customers who subscribe to ListenTo have their data protected by GDPR.
ListenTo is designed with privacy are a core tenet during the inception of all ideas and projects, therefore supporting the Privacy by Design and Default principles.
If you have a ListenTo account, ListenTo lets you delete account data permanently via our Settings page's "Delete Account" option. If you do not have a ListenTo account and have simply visited ListenTo links or properties, all data collected is anonymized and we do not collect any identifiable information about you.
ListenTo supports requests for data exports. If you wish you receive an exported copy of your ListenTo accounts data, please contact us at listento.service+g[email protected]il.com and we will be happy to assist.
The GDPR includes a right for individuals to have inaccurate personal data rectified or completed if it is incomplete. ListenTo account holders can rectify any errors in their personal data by editing their profiles.
